These Terms & Conditions govern your access to and use of the KubezX website, public demonstrations, contact features and other digital services that link to these Terms. By accessing or using these services, you agree to comply with these Terms. If you do not agree, you should not use the affected services.

Separate customer agreements, order forms, subscription terms or enterprise contracts may apply to paid KubezX services. If a separate signed agreement conflicts with these Terms, the signed agreement will control for the services it covers.

KubezX is building a technology platform and related digital services focused on connected business operations, customer communication, workflows, data, automation and operational intelligence. Some features described on the website may be prototypes, demonstrations, planned capabilities or services that are not yet generally available.

You may use the KubezX website and available services only for lawful purposes and in accordance with these Terms. You must not misuse the services, attempt unauthorised access, interfere with security or availability, introduce malicious code, impersonate another person or organisation, or use the services to violate the rights of others.

You must not attempt to reverse-engineer, reproduce or commercially exploit protected KubezX software, designs, content or systems except where applicable law expressly permits it or KubezX has given written permission.

Where an account is required, you are responsible for providing accurate information, keeping credentials confidential and taking reasonable steps to protect your account. You should notify KubezX promptly if you believe an account, credential or authorised integration has been compromised.

KubezX may require additional authentication, access controls or verification for sensitive functions and may restrict access where reasonably necessary to protect users, data, systems or third parties.

KubezX may provide AI-assisted, automated or data-driven features. These features can produce incomplete, inaccurate or unexpected outputs and should not be treated as a substitute for appropriate professional judgement or human review.

Users remain responsible for decisions made using KubezX outputs. Important legal, financial, safety, employment, medical, compliance, security or high-impact operational decisions should be reviewed by appropriately authorised people before action is taken.

You retain the rights you hold in content and data that you lawfully provide to KubezX. When you submit data for use with a KubezX service, you grant KubezX the limited rights reasonably necessary to host, process, transmit and otherwise handle that data to provide, secure, maintain and improve the agreed service, subject to applicable privacy obligations and any separate customer agreement.

You are responsible for ensuring that you have the legal right and any required permissions to provide data to KubezX, including personal information, recordings, images, documents or third-party business data.

Unless otherwise stated, the KubezX name, logos, website design, software, workflows, documentation, graphics, product concepts and other original materials are owned by or licensed to KubezX and are protected by applicable intellectual-property laws.

Nothing in these Terms transfers ownership of KubezX intellectual property to a user. Any rights not expressly granted are reserved.

KubezX may connect with third-party cloud, communications, AI, mapping, payment, analytics or business services. Third-party products are governed by their own terms, privacy practices and availability. KubezX is not responsible for changes, outages or conduct of independent third-party providers beyond the responsibilities imposed by applicable law or an agreed customer contract.

The public website may be used without a paid subscription unless stated otherwise. If KubezX introduces paid plans, subscriptions, usage-based services or implementation fees, the applicable pricing, billing cycle, taxes, renewal, cancellation and refund terms will be disclosed before purchase or set out in a separate order form or customer agreement.

KubezX may update, improve, suspend or discontinue website features or services as the product develops. While KubezX aims to provide reliable services, uninterrupted or error-free availability is not guaranteed unless a separate written agreement expressly provides a service commitment.

Beta, pilot, preview or demonstration features may change materially and should not be relied upon as production services unless KubezX expressly confirms otherwise in writing.

KubezX may restrict or suspend access where reasonably necessary to address suspected fraud, unlawful activity, abuse, security threats, non-payment, material breach of these Terms or risk to KubezX, its users or third parties. Where appropriate, KubezX will seek to provide notice and a reasonable opportunity to address the issue.

To the maximum extent permitted by applicable law, the public website, demonstrations and pre-release features are provided on an “as available” basis. KubezX does not make guarantees about uninterrupted availability, error-free operation or the suitability of a public demonstration for a particular business decision.

To the maximum extent permitted by law, KubezX will not be liable for indirect, incidental, special or consequential loss arising solely from use of the public website or reliance on demonstration or AI-generated output. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Use of personal information is subject to the privacy information provided by KubezX. Where cookies or similar technologies are used, KubezX will provide appropriate information and controls in accordance with applicable requirements. Dedicated Privacy and Cookie policies may be published separately as the website and platform expand.

These website Terms are governed by the laws of Fiji, without limiting any mandatory rights that may apply under the law of another jurisdiction. Before commencing formal proceedings, the parties should first attempt in good faith to resolve a dispute through direct communication where appropriate.

Paid, enterprise or international customer agreements may specify a different governing law, venue or dispute-resolution process.

KubezX may update these Terms to reflect changes in the website, services, law, security requirements or business operations. The current version and effective date will be published on this page. Continued use after an update takes effect means the updated Terms apply to subsequent use, subject to applicable law.
